This website, pestcalm.com, is operated by ONECAB LLC, a New Mexico limited liability company doing business as PestCalm. By visiting our site or purchasing from us, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase.

2. Products and descriptions

We make every effort to describe our products accurately. PestCalm products are pest deterrents designed to discourage pests from staying in the covered area. They are not extermination products or services, and results vary with home layout, pest species and infestation level. Product descriptions, coverage figures and timelines are typical expectations, not guarantees. Colors may vary slightly from images.

3. Safe use

Use products indoors, in standard US 110 to 120 V outlets, according to the instructions provided. Do not use in rooms where small rodent pets live. Discontinue use if the device is damaged.

4. Pricing, orders and payment

Prices are in US dollars and may change without notice. We reserve the right to refuse or cancel any order, including for pricing errors, suspected fraud or stock issues, in which case you will be refunded in full. Payment is processed by our payment providers at checkout. Sales tax is collected where required by law.

5. Shipping, returns and guarantee

Our Shipping Policy and Refund Policy are part of these Terms.

6. Intellectual property

All content on this site, including text, images, logos and the PestCalm name, belongs to ONECAB LLC or its licensors and may not be copied or used without written permission.

7. Reviews and user content

By submitting a review or other content, you grant us a non-exclusive, royalty-free license to use it in connection with our business. We only publish genuine reviews from customers and do not pay for reviews.

8. Prohibited uses

You may not use the site for any unlawful purpose, to infringe our or others' rights, to transmit malicious code, or to scrape or interfere with the site.

9. Disclaimer of warranties

To the fullest extent permitted by law, products and the site are provided "as is" and "as available", without warranties of any kind beyond our express guarantee, including implied warranties of merchantability or fitness for a particular purpose. Some states do not allow limitations on implied warranties, so some of these limitations may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, ONECAB LLC will not be liable for any indirect, incidental, special or consequential damages, including property damage from pests, arising from your use of the products or the site. Our total liability for any claim will not exceed the amount you paid for the product concerned. Nothing in these Terms limits rights you have under applicable consumer protection law.

11. Indemnification

You agree to indemnify ONECAB LLC against claims arising from your breach of these Terms or misuse of the products.

12. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law rules. Before filing any claim, you agree to contact us at support@pestcalm.com and attempt to resolve the dispute informally for 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in New Mexico, unless applicable law gives you the right to bring it elsewhere.

13. Changes

We may update these Terms at any time by posting the revised version here. Continued use of the site after changes means you accept them.
